If you have to endure increasingly long waiting times for routine elective surgery, there could be a solution for you.

In some cases, you can ask to be switched to a different hospital waiting list if you have been told that you will have to wait for treatment for more than 18 weeks.

What is the 18-week rule in the NHS?


Your options

If you need to see a consultant you can ask to change your hospital if:

  • your treatment is not urgent and you have to wait more than 18 weeks before starting treatment for a physical or mental health condition
  • you have to wait more than two weeks before seeing a specialist for suspected cancer

Your Integrated Care System (ICS), or NHS England (if you have been referred to a consultant-led specialised service), must take all reasonable steps to ensure that you are offered an appointment at a suitable alternative organisation that can start your treatment earlier than if you were to continue to wait for treatment from the provider you originally chose. If there is more than one suitable alternative organisation, you must be offered a choice from all of them.

Are these legal rights?

Yes, but there are circumstances in which you may not ask to change your hospital.

When may I not ask to change to a different hospital?

If you have to wait for more than 18 weeks for non-urgent treatment to start, you do not have a legal entitlement to ask to be switched to a different hospital waiting list if:

  • the services you are using are not led by a consultant
  • you choose to wait longer for your treatment to start
  • delaying your treatment is down to a risk associated with treating you at that time – i.e. you do not currently meet the safe criteria for treatment
  • you fail to attend appointments which you had chosen from a set of reasonable options
  • you decide not to start, or you decline, treatment
  • a doctor has decided that it is appropriate to monitor you for a time without treatment
  • you cannot start treatment for reasons not related to the hospital, for example, you are a reservist posted abroad while waiting to start treatment
  • your treatment is no longer necessary
  • you are on the national transplant list
  • you are using maternity services.

Comparing hospital waiting times

The NHS Waiting List Tracker is a useful tool for keeping an eye on current waiting lists. You can also compare by area of the UK. For instance, the tool allows you to see that currently, North-East London, Kent and Medway, and Birmingham have the highest waiting lists. On the contrary, Portsmouth, Blackburn and Knowsley currently have the shortest NHS waiting lists in the UK for orthopaedic surgery.

How long is the NHS waitlist?

According to a report from the Royal College of Surgeons in England, the number of patients on the NHS waiting list reached six million in 2022. Of these, over 18,500 had been waiting for more than two years for their surgery. Patients on the waiting list for hip replacement face the longest waiting times1.

What are the maximum hospital waiting times?

According to the NHS website, the maximum waiting time for non-urgent referrals is 18 weeks from when your appointment is booked. However, as has already been mentioned, in some areas of England and the UK, patients have been on the surgery waiting list for more than two years.

Where am I on the NHS waiting list?

While there’s currently no way to discover your exact position on the NHS waiting list, there are resources that patients waiting for treatment can use. Both the NHS Waiting List Tracker and My Planned Care are resources that can provide patients with the current waiting times in their area.

How can I check hospital waiting times near me?

NHS resources such as the Waiting List Tracker and My Planned Care provide information as to waiting times in your area.

Why are NHS waiting times so long?

The answer to this question isn’t solely down to one reason. The following are all contributing factors to the lengthening on NHS waiting times:

  • Population growth – increasing population means more people needing medical treatment
  • COVID-19 pandemic – the pandemic saw COVID patients given priority over those on waiting lists for non-life threatening surgery. This created waiting list backlogs that weren’t attended to until restrictions were eased
  • Loss of qualified medical professionals – between 2016 and 2019, the number of qualified, permanent GPs and practice nurses fell by 5% for GPs and 2% respectively2

The effects of the pandemic on hospital waiting times

As mentioned previously, the impact of the COVID pandemic on both health services and waiting times has been profoundly negative. From February 2020 onwards, COVID patients were prioritised over those needing non-life threatening surgery (such as knee and hip replacements). This meant the waiting list grew and now counts among the highest levels ever. The number of people waiting for surgery on the NHS currently stands at over six million people.

What to do while you wait for your surgery

The type of surgery you need will dictate the kind of preparation you can do. If, for example, you need knee, hip or eye surgery, you should start to prepare right away. Removing hazards from your home (loose rugs and cables) to prevent falling, placing items within reach, and clearing space for walking with crutches, are all good ideas for preparation.

You should also consider strengthening and conditioning your body prior to surgery. Maintaining a healthy weight also reduces the amount of stress that will be put on the knee joint post-op.

Anti-inflammatory medication can help significantly. They can help manage the pain, allowing you to carry out daily activities and maintain a level of fitness.

How can I get surgery faster?

If you’re currently on a waiting list, you can read about tips for having your NHS surgery sooner. However, if you want to reduce surgery waiting times, there are alternative options to the NHS. You may want to consider self-pay private healthcare. At Practice Plus Group, we follow a consultant-led approach. You will be supported throughout by an expert Consultant and a Private Health Coordinator who specialise in hip and knee replacements.

If, after your initial enquiry, you are eligible for surgery (and happy to proceed), you will receive a no obligation appointment. This will cost £95 and includes your x-ray. It will take place at a Practice Plus Group hospital appropriate for you within 2-3 weeks of enquiry.

After further consultation, your Private Health Coordinator will help arrange your surgery dates. They will also provide you with all of the relevant information you will require to prepare and start treatment. Surgery normally takes place between two and four weeks of your consultation.

Foot and ankle surgery, Shepton Mallet – I am indebted to you all

I needed some corrective surgery on my foot which I was initially told would be not be available on the NHS. However, I had a successful referral from OASIS and the whole experience has been trouble free. Appointments all delivered on time with super friendly staff. I had my operation yesterday at Shepton Mallet and the theatre team were just fantastic (at the age of 65 this was my first experience of a medical theatre). I had a full knee replacement on 19th February 2019, that’s two days ago. I came home yesterday, that’s the day after the surgery, and after receiving the very best care and treatment from every single member of staff I came into contact with. Thank you to Mr Lovasz and Ward M. Firstly I would like to show my appreciation for my competent diagnosis and subsequent surgery on 3/1/20 from Mr Lovasz. The treatment I received from all the nursing teams (including Gemma, Kelly and all of the team on the ward I was on) who were on duty day and night. Right through to the x-ray team; the porters, catering team and cleaning staff who worked hard as a team to show me cheerfulness, care, empathy, clear communication and concern whilst I was in hospital; the process from the hospital’s administration team (Bethany and Mandy) at the beginning of my referral, right through to physiotherapy team (Elizabeth, Orville, Lawrence and the rest of the physio team) after having a full knee replacement was greatly appreciated.
Professionalism was shown by the nursing, surgery, anaesthetic and physiotherapy teams who were exemplary. I am full of admiration for the NHS’ hard-working teams who work at this hospital, they really do deserve appreciation, praise and more. The authority should be really proud of the NHS teams who work in this hospital. My husband recently had hip replacement surgery carried out at the Shepton Mallet Treatment Centre and has not looked back since!!! He would like to take this opportunity to thank all of the staff at the Centre, with a special thank you to Mr Adam Rozycki his Orthopaedic Consultant Surgeon, who did a wonderful job replacing his hip joint, now totally free of pain! Knee replacement surgery, Plymouth – outstanding service

My mum had a knee replacement carried out by Mr Wudecki on Wednesday and was discharged home on Thursday. Prior to the op, James Potter was absolutely fabulous in going above and beyond. He is such a kind, caring man and an expert at what he does. We are very grateful for all that he did. All theatre staff were brilliant, especially the lovely Assistant Anaesthetist, Emma. My mum couldn’t believe how relaxed she felt before and during the surgery as she was falling asleep. She described it as a really positive, relaxed experience and isn’t worried about having her other knee surgery. The staff on the ward were outstanding: domestic staff, catering staff, HCA’s, Nurses, Physiotherapists, Doctors, Pharmacists…everyone!! They provided a very calm, relaxed atmosphere which is so important when you or someone you love is having surgery. Staff were very attentive and nothing was ever too much trouble. My mum enjoyed the food and there was always plenty on offer. My mum felt so, so well looked after. She was sent home with all of the support she might need, given all of the necessary contact details and informed of the next steps. Shout out to HCA Robyn who was like a lovely ray of sunshine! Practice Plus Group Hospital, Plymouth provided an outstanding service and enabled my mum to have a very positive knee replacement experience. The surgeon Mr. Dehne did an excellent job, now just a neat trouble free scar testament to his skilful intervention. All the staff were helpful and efficient, starting from the reception, through to the ward. Nothing was too much trouble for them. My physiotherapist was exceptionally helpful and patient in getting me back up on my feet, making sure before I left, I knew how to continue the exercises to practice at home.

Hernia repair surgery, Emersons Green – recommend this hospital 100%

At age 65 and having my first major surgery (in my mind) in my life was referred to Emersons Green for an inguinal hernia repair. Staff at assessment were very reassuring and professional, especially Ms Paula Sabino dos Santos, my surgeon who explained everything perfectly. On the day of surgery Wed’s 12th September reception staff very friendly and efficient. Pre and post op’ was looked after by Ms Amparo Herrero-Canovas – absolutely lovely and caring, nothing was too much trouble for her. Cannot fault hospital or staff, they couldn’t have done anymore to make me feel more calm or comfortable. Would recommend this hospital 100%. Many thanks to all concerned.

Hernia repair surgery, Emersons Green – no hesitation in returning

I developed a groin hernia in June 2022 wich caused a considerable amount of discomfort, the NHS waiting time for a repair was up to 18 months so decided to go as a fee paying patient. Practice Plus Group Hospital, Plymouth did not do general surgery so advised me to attend Practice Plus Group Hospital, Emerson’s Green, Bristol. I then met consultant surgeon Paula Sabino Dos Santos who immediately put me at ease and spoke in the language I understood and was very thorough I was very confident and happy with her particularly as she was happy to perform the surgery herself, on the day of surgery I met Paula to make sure I was ok and happy to go ahead so went for surgery and all seemed to go well, came round in recovery and was greeted with a very attentive Nurse Urszula who was wonderful and did not seem to leave my side until discharge overall the whole nursing team were wonderful, I would have no hesitation in returning or recommending the services, and a special thanks to Paula and Urszula.

I decided to use Barlborough Hospital for a total hip replacement after my mum had a very positive experience when she had her knee replaced. The consultation was a very reasonable price, very “no nonsense”, and included an x-ray [. . .]. The surgery by Mr Toth has turned out better than I had hoped regarding leg length, positioning of the implant etc. It’s all pretty much perfect. Although I had a spinal injection I was still asleep for the whole procedure, waking up in recovery wondering when they were going to start. All the staff are very kind, reassuring and professional. And I mean all of them, theatre staff, nursing staff, physio, porters, food, the list goes on [. . .]. In summary, thanks to all, I’ll see you if I have to come back for the other one.

Total knee replacement surgery, Barlborough – first class treatment

I have just had a total knee replacement on 20th March came home on Sunday, I cannot thank the surgeon Mr Toth and his theatre team enough it was a pleasurable experience dancing to my music before I went in couldn’t get my Bluetooth working on head phones but it lightened the mood for a few seconds. The recovery nurses were chatty, the nursing staff on the ward are fabulous nothing was too much trouble the physio people and cleaning staff and catering staff were also the same, last but not least the admin staff. This is the second time I’ve been here to have a knee replacement done I’ve now got a matching pair. The Balborough Treatment centre is excellent first class treatment centre both my self and husband have had treatment here. Please stay safe and carry on the professional jobs you do without our front line staff we would be in a mess in the current climate.

Trigger finger release surgery, Barlborough – I would definitely recommend

I had trigger finger release surgery in October. All the nurses, reception staff and Mr Toth were all so kind and caring and nothing was ever too much trouble. Aftercare was second to none with phone calls checking how I was and how the operation had gone. Still attending now for physio on my finger and again all the physiotherapists are so friendly and caring. I came here for a Sleeve Gastrectomy with the great Dr. Peter Vasas. My surgery went smoothly and I had the most amazing support from staff before and after. I couldn’t remember everyone’s name but Kerry, Jane, Atila and either Ava/Amy (theatre staff) were all amazing. Every staff member I spoke to was so kind and caring. Please could you convey my grateful thanks to absolutely everyone in the Orthopaedics Department. The Anaesthetist was right I didn’t feel a thing, the surgeon who carried out the procedure, brilliant. The physios, the nurses (day and night), ward attendants. I could not have received any better treatment ANYWHERE. I came out of the theatre sitting up with a big smile on my face, no pain or discomfort. The whole experience has made a massive change in my life, I am walking upright without the grimace of pain on my face. It is just a couple of weeks now and the healing is going well. I had a uni-knee replacement operation on 20th February and six weeks later I am very pleased with it. I had excellent care throughout my stay and everything matched or exceeded my expectations. Although paying for it myself was daunting I am glad I had the op and the certainty of a set fee made it less worrying. Hip replacement, Ilford – very professional, very respectful

I’ve had three procedures here now, two hip replacements and, on 03/05, my second knee replacement operation. I cannot fault my treatment at any point during my stay. The nursing team on Kingfisher Ward, both day and night, were superb. Very professional, very respectful and had a great sense of humour which put everyone at ease. The consultant surgeon, Mr Fabula, along with his very slick team, was awesome and did an amazing job as always. After about 30-40 minutes in recovery I was back on the ward where coffee/tea and toast was provided within minutes of arriving! Surgery is rarely fun, but the Kingfisher Ward Team made me feel absolutely as best as I could under the circumstances. The following day, the Physio Team were in and quickly assessed that I could use my crutches and do stairs, so after x-rays and a quick blood test, it was back home. I would like to take this opportunity to thank the Kingfisher Ward, the Kitchen and Physio Teams for taking the best care of me during my stay, and especially to Mr Fabula, who has now done three of my four joint replacements, for carrying out another top-quality surgical procedure. I had a full knee replacement on Tuesday and I couldn’t praise this unit enough. The nurses and catering staff were very friendly. The nurses also explained everything that was going to happen with my operation and answered any of my concerns. The doctor and anaesthetist also explained to me all about what they were going to do and checked that I was happy before they proceeded. After my operation the nurses were there to help with all my needs. This unit is covid/disease secure so no visitors are allowed but you can take in your mobile phone or tablet and the Wi-Fi is free.

I had a knee replacement a few days ago and I cannot praise the staff here too highly. From the cleaners to the surgeons everyone treated me with respect and kindness. Every stage of my procedure was explained carefully to me and they made sure I understood it all. The lady that cooked and delivered food was a joy and the food was excellent and presented in a way that made you want to eat it. I am unable to give a name of someone who stood out as every single person was excellent. I was in over a weekend so the staff changed every day but this made no difference at all to my care. Gastroscopy, Shepton Mallet – 10/10 to all staff

Came in for Gastroscopy (stomach observation via camera) at the Practice Plus Group Hospital, Shepton Mallet. From the helpful smiling face at reception to being assessed by staff, and discussion in theatre, all were helpful to put my mind at rest. The dedicated staff kept me calm which really helped me. Hip surgery, Shepton Mallet – back walking almost five miles a day

I was amazed at both the lack of hip and knee pain and the fact that I could walk so soon after the surgery. I’m making a fantastic recovery and am back walking almost five miles a day, including steep hills, and doing the exercises advised by the physiotherapist. From my very first visit, the care and consideration I received from the staff at the hospital was wonderful. Everyone I met in every role was wholly engaged as they performed it – receptionists, cleaners, x-ray technicians, nurses, doctors and other health professionals. My experience was extremely well managed.

I attended [Practice Plus Group Surgical Centre, St Mary’s Portsmouth] Treatment Centre on Sunday with my 7 year old daughter as she had broken her ankle and just wanted to feedback on our experience. The centre was exceptionally busy but every member of staff we encountered was amazing: positive, calm and just absolute stars! The situation could have easily felt really out of control with how busy it was but we were given regular updates to waiting times and to thank us for our patience. Cataract surgery – quick and well organised

The whole process was very quick and well organised from first contact to being discharged. The initial telephone contact allowed me to ask questions and be directed to the clinic which would best suit my needs. Everyone involved was very friendly and quickly put me at ease. I was always explained choices and not pressured into any response. My concerns were fully answered enabling me to feel confident to go ahead. I loved my consultants humour during the procedure keeping me involved and relaxed. My eyesight is amazing now with no need to wear glasses so I’m extremely satisfied.

Dental surgery, Devizes – wonderful staff

I had a tooth out today which I had been dreading and due to this I was referred to the Devizes Surgical Centre for local anaesthetic. Despite being petrified, my experience was made 100 times better by the wonderful staff and even after having a bit of a panic during the procedure, I was calmed and cared for to such a great extent! Even down to one of the staff members holding my hand and soothing me to calm my breathing. Couldn’t have asked for anything more! Thank you all and especially to to team who helped me, I only remember a couple of names of Al & Toni, but the whole team were more than amazing!
